In Mexico, iFone beats out iPhone

Como se dice ?tough luck, Apple??

Apple Inc. reportedly has lost a trademark case in Mexico against a call center technology company called iFone.

According to Fox News Latino, Apple filed a complaint against iFone for using its name back in 2009. But it turns out that iFone had registered its name in Mexico in 2003, while Apple didn?t trademark iPhone until 2007. IFone countersued for damages and to stop Apple from selling iPhones in Mexico.

An appellate court ultimately decided last week to deny Apple an injunction that would have let it keep selling iPhones in Mexico, Fox News Latino said.

Venture Beat suggests a settlement is likely, but the court ruled Apple must now pay ?sanctions up to the amount of 20,000 days of minimum wage? and 40 percent of iPhone sales in Mexico, VentureBeat said. Apple doesn?t break down its sales by country, but presumably that could add up to quite a bit of dinero.
