Se?or Fish on the hook for underpaying hourly wages ? Business ...

Los Angeles-area restaurant chain Se?or Fish has agreed to a settle a Fair Labor Standards Act (FLSA) lawsuit with the U.S. Department of Labor. An investigation by the department?s Wage and Hour Division (WHD) revealed the taquer?a business paid its employees ?straight time? for all hours worked, even if they were on the clock for more than 40 hours per week.

Based on the settlement, Se?or Fish will pay 74 current and former employees $56,777 in back wages and $33,154 in liquidated damages.

In addition, the settlement requires the restaurant to install a computerized timekeeping system. It also agreed to have WHD staff members provide training to Se?or Fish employees during regular work hours on FLSA requirements, with instruction in both English and Spanish.

The restaurant also will post links to the Department of Labor website so employees will be able to access information about labor laws and obtain the department?s free timesheet application, which lets employees record the hours they work on mobile phones.
